“掌握婚约的人” 这几个字, 可以意指丈夫或离婚妇女的监护人, 因为婚后的婚约掌握在丈夫手中, 而婚前掌握在监护人手中。
يَعْفُ (Ya‘fu) 可以意指 “宽免或增加”。妻子 (或她的监护人) 可以给她的全部或部分聘礼, 或者丈夫可以多付些比他应该拿出来的聘礼。不过, 丈夫肯定要多付些聘礼以表示他比较慷慨。

The clause, he in whose hand is the tie of marriage, may signify either the husband or the guardian of the divorced woman, because whereas after marriage the tie of marriage is in the hands of the husband, before marriage the guardian of the woman holds it.

The clause, he in whose hand is the tie of marriage, may signify either the husband or the guardian of the divorced woman, because whereas after marriage the tie of marriage is in the hands of the husband, before marriage the guardian of the woman also holds it in his hands. In the former case, the word یعفو would mean that the husband should try to give more than half the dowry, or if he has already paid the whole dowry, he should try not to demand its return. If, however, the clause, he in whose hand is the tie of marriage, be considered to apply to the guardian of the divorced woman, the word یعفو would mean that he should try to remit or relinquish her right, i.e. he should, so far as possible, strive to give up, even that which he is entitled to receive on behalf of the divorced woman. But God certainly prefers that the husband should make a greater show of generosity.
This is how each party is exhorted to vie with the other in acting generously toward the other, the husband by paying more than what is obligatory on him, and the wife or her guardian by relinquishing what is due to her. If people truly inculcated such a spirit of sacrifice, the earth would indeed become a heaven.
The expression, And that you should remit is nearer to righteousness, applies to the husband particularly; but it may, in its broader significance, apply to all__husbands, wives and guardians.

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِذَا تَدَايَنتُم بِدَيْنٍ إِلَىٰٓ أَجَلٍ مُّسَمًّى فَٱكْتُبُوهُ ۚ وَلْيَكْتُب بَّيْنَكُمْ كَاتِبٌۢ بِٱلْعَدْلِ ۚ وَلَا يَأْبَ كَاتِبٌ أَن يَكْتُبَ كَمَا عَلَّمَهُ ٱللَّهُ ۚ فَلْيَكْتُبْ وَلْيُمْلِلِ ٱلَّذِى عَلَيْهِ ٱلْحَقُّ وَلْيَتَّقِ ٱللَّهَ رَبَّهُۥ وَلَا يَبْخَسْ مِنْهُ شَيْـًٔا ۚ فَإِن كَانَ ٱلَّذِى عَلَيْهِ ٱلْحَقُّ سَفِيهًا أَوْ ضَعِيفًا أَوْ لَا يَسْتَطِيعُ أَن يُمِلَّ هُوَ فَلْيُمْلِلْ وَلِيُّهُۥ بِٱلْعَدْلِ ۚ وَٱسْتَشْهِدُوا۟ شَهِيدَيْنِ مِن رِّجَالِكُمْ ۖ فَإِن لَّمْ يَكُونَا رَجُلَيْنِ فَرَجُلٌ وَٱمْرَأَتَانِ مِمَّن تَرْضَوْنَ مِنَ ٱلشُّهَدَآءِ أَن تَضِلَّ إِحْدَىٰهُمَا فَتُذَكِّرَ إِحْدَىٰهُمَا ٱلْأُخْرَىٰ ۚ وَلَا يَأْبَ ٱلشُّهَدَآءُ إِذَا مَا دُعُوا۟ ۚ وَلَا تَسْـَٔمُوٓا۟ أَن تَكْتُبُوهُ صَغِيرًا أَوْ كَبِيرًا إِلَىٰٓ أَجَلِهِۦ ۚ ذَٰلِكُمْ أَقْسَطُ عِندَ ٱللَّهِ وَأَقْوَمُ لِلشَّهَٰدَةِ وَأَدْنَىٰٓ أَلَّا تَرْتَابُوٓا۟ ۖ إِلَّآ أَن تَكُونَ تِجَٰرَةً حَاضِرَةً تُدِيرُونَهَا بَيْنَكُمْ فَلَيْسَ عَلَيْكُمْ جُنَاحٌ أَلَّا تَكْتُبُوهَا ۗ وَأَشْهِدُوٓا۟ إِذَا تَبَايَعْتُمْ ۚ وَلَا يُضَآرَّ كَاتِبٌ وَلَا شَهِيدٌ ۚ وَإِن تَفْعَلُوا۟ فَإِنَّهُۥ فُسُوقٌۢ بِكُمْ ۗ وَٱتَّقُوا۟ ٱللَّهَ ۖ وَيُعَلِّمُكُمُ ٱللَّهُ ۗ وَٱللَّهُ بِكُلِّ شَىْءٍ عَلِيمٌ

口授的人应该是债务人而不是债权人, 因为: (1) 负责任的是债务人; 有关决定性的话, 应该由他来选择才公正; (2) 借据由债权人而不是由债务人保存。因此要求债务人口授, 使他口授的事情可以作为借款数目和付款条件准确的证明。他就没有原因和根据来否认这笔借款。
这里含有这样的意思, 即使在这种情况下, 还是写一张像现款便笺或收条之类的字据比较好。

اِلٰی اَجَلٍ مُّسَمًّی۔ اس میں اِلٰی یا تو لام کے معنوں میں ہے اور معنے یہ ہیں کہ مقررہ میعاد کے لئے قرض لو اور اِلٰی ان معنوں میں عربی میں استعمال ہوتا ہے۔ جیسے قرآن کریم میں آتا ہے وَ الْاَمْرُ اِلَیْکِ یعنی حکم دینے کا اختیار تجھے حاصل ہے۔ یا کہتے ہیں اَحْمَدُ اِلَیْکَ اللّٰہَ: تیرے لئے اللہ کی حمد کرتا ہوں (مغنی) اور یہ بھی ہو سکتا ہے کہ اِلٰی‘ مَعَ کے معنے دیتا ہو۔ یہ معنے عربی میں مستعمل ہیں۔ قرآن کریم میں بھی آتا ہے مَنْ اَنْصَارِیْ اِلَی اللّٰہِ یعنی کون اللہ کے ساتھ ہو کر میری مدد کرتا ہے۔ اس اِلٰی کے لئے یہ شرط ہوتی ہے ک
’’تمہارے درمیان‘‘ اس کے یہ معنے بھی ہو سکتے ہیں کہ جو معاہدہ تمہارے درمیان ہوا ہے وہ لکھ دے اور یہ بھی کہ کاتب تمہارے اپنے آدمیوں میں سے ہو۔ اور یہ بھی کہ وہ دونوں فریق کی موجودگی میں ان کے سامنے بیٹھ کر لکھے۔
یہ آیت ترجمہ کے لحاظ سے بہت پیچیدہ ہے کیونکہ اس میں شُھَدَآء کا لفظ موقع پر موجود ہونے والوں کے لئے استعمال کیا گیا ہے اور ایک ہی فقرہ میں دو معنوں میں گواہ کے لفظ نے ترجمہ میں پیچیدگی پیدا کر دی ہے۔ مطلب یہ ہے کہ جس وقت تحریر لکھی جا رہی ہو اگر لکھنے والے کے سوا جو مرد و عورت وہاں موجود ہوں ان میں سے وہ دو مردوں کو گواہ مقرر نہ کرنا چاہتا ہو بلکہ کسی عورت کو بھی شامل کرنا چاہتا ہو تو اس صورت میں جو لوگ موقع پر ہوں ان میں سے دونوں فریق کے اعتباری لوگوں میں سے ایک مرد اور دو عورتوں کی شہادت ڈلوائی جائے۔
حَاضِرَۃً کا ترجمہ ’’دست بدست‘‘ کیا گیا ہے۔ یعنی جب مال پر اسی وقت قبضہ کر لیا گیا ہو اور قیمت نقد ادا کر دی گئی ہو۔
اس میں اشارہ ہے کہ اس صورت میں بھی لکھنا اچھا ہے جیسا انگریزی دکان دار ووچر (Voucher) دیتا ہے۔ اس سے جھگڑے کم ہو جاتے ہیں۔
یہ بہت بڑے سَودوں کے متعلق ہے کہ ان کو لکھنا بھی چاہیے اور گواہ بھی رکھنے چاہئیں تا فتنہ نہ پیدا ہو۔

So the borrower has been asked to dictate so that the fact of his having dictated may serve as a proof of the correctness of the amount and the conditions about payment, and he may have no cause or ground to deny it.
The implication is that it would be better to have a writing even in such a case like cash memo or voucher.
This refers to big transactions.

Commentary:
As the preceding verses prohibit interest and enjoin that only the original sum taken as a loan be returned to the creditor, the Quran now fittingly turns to the subject of loans not carrying interest. The verse enjoins that all transactions regarding loans should be committed to writing. It is really amazing, and is indeed a wonderful testimony to its Divine origin, that the Quran, which was revealed about 1,350 years ago when the art of writing was yet in its infancy, should lay so much stress on writing down all transactions.
The verse should not be interpreted to signify that only such transactions should be committed to writing as have a fixed term for the paying back of a loan. The injunction is general and is meant to obviate or minimize disputes so as to leave no room for doubt as to whether any amount has really been lent and as to the amount of the money lent. The words, for a fixed period, have been added to emphasize the additional fact that whenever a loan is advanced, a term must be fixed.
The verse further enjoins that when a transaction is made on credit, the document drawn up should be written by a third person so that there may be little chance of fraud and neither of the parties may have a cause of complaint against the other, both standing on the same level.

The words "such as you like", point to the fact that the witnesses, whether men or women, should be desirable persons and should enjoy the confidence of both parties.
The clause, and let no harm be done to the scribe or the witness, signifies that if the scribe is a professional man, he should be duly paid for his services; otherwise wrong would be done to him. Similarly, a person should not be compelled, so far as possible, to become a witness if it causes him loss of any kind. Again, the scribe or the witnesses should also be paid their travelling and other necessary expenses when they are summoned before a Qadi or judge. The words also hint that the witnesses and the scribe should not be forced or threatened or bribed or otherwise influenced to suppress the truth or tell a falsehood when called upon to give evidence.

ان الله یرفع بھذا القرآن اقوا ما و یضع اقواما
i.e. Allah will, by means of this Quran, exalt some peoples and humble others (Majah).
Again he says:
من تواضع لله رفعه الله الی السماء السابعة
i.e. he who truly humbles himself for the sake of God, God would lift him to the seventh heaven, i.e. would exalt him to the highest spiritual station (‘Ummal, ii. 25). The Quran has described the Day of Resurrection as خافضة رافعة meaning, it shall debase some and exalt others (56:4). In the Quran we also have فی بیوت اذن الله ان ترفع i.e. in houses with regard to which Allah has commanded that they be exalted (24:37). Again: العمل صالح یرفعه i.e. the righteous work of a man exalts him (35:11). Even in our daily Prayers we pray: اللھم ارفعنی i.e. O God, exalt me. This verse has been linked up with the preceding one with the word اذ (when), thus indicating that it provides what is known as ظرف for the concluding clause of that verse, i.e. Allah is the Best of planners. The present verse thus relates to the occasion when Jesus was being made a victim of the evil machinations of his enemies who were plotting to have him crucified and thereby prove him to have come to an accursed end (Deut. 21:22, 23). "Nay", says God to Jesus as stated in the verse under comment, "thine enemy shall not be permitted to kill thee on the cross and thereby prove thee to be low and debased spiritually. On the contrary, I will cause thee to die a natural death and will exalt thee in My presence…" This is the only possible meaning of the verse in conformity with the context. Unfor-tunately, however, the verse is one of those which have heavily suffered from misinterpretation. Meanings have been sought to be put upon its words which they are simply incapable of bearing. It is now an admitted fact that, through the free intermixture of Muslims and Christians and the conversion en masse of hundreds of thousands of Christians to Islam, the belief that Jesus had risen up to heaven alive found widespread credence among Muslims, the misunderstanding of the prophecy about the second advent of Jesus lending support to it.
There is no gainsaying the fact that Jesus is dead, and not alive in heaven. The Holy Prophet is reported to have said, "Had Moses and Jesus been now living, they would have found themselves bound to follow me" (Kathir). He even fixed the age of Jesus as 120 (‘Ummal). The Quran, in as many as 30 verses, has completely demolished the absurd belief of the physical ascension of Jesus and his supposed life in heaven. The arrangement of words in the verse under comment also leaves no doubt about the death of Jesus. Four distinct promises have been made to Jesus in the verse: (1) his being saved from death on the cross and dying thereafter a natural death; (2) his exaltation in God’s presence; (3) his exoneration from the false charges of his enemies, and (4) the domination of his followers over his rejecters. The last three promises have already been fulfilled; but what of the first? It is idle to speak of تقدیم and تاخیر (i.e. the first-mentioned promise to be read after the others) without any justifying reason. It is idle also to claim that متوفیك here means, "I will cause thee to sleep". The Quranic idiom spurns the idea. Indeed such a meaning makes the verse almost ridiculous.
The verse beautifully describes in four brief words the frustration of the plans of the Jews referred to in the preceding verse. They had planned (1) to bring about the death of Jesus by crucifixion; and (2) to be thus able to say that because he was a false prophet, he died an accursed death on the cross (Deut. 21:22, 23). They also sought (3) to bring false charges against him, especially the heinous charge of an illegitimate birth; and (4) to be thus able to compass the destruction of his entire movement. They were completely foiled in all these designs. Jesus died, not on the cross, but a natural death, respected and revered by devoted followers. He was cleared of the false charges imputed to him and has ever been regarded as one of the sacred band of God’s great Prophets. Last of all, his followers have for centuries held his rejecters, the Jews, under their heels.
The words, those who follow thee, originally referred to the Christians and the words, those who disbelieve, to the Jews. Later, however, when Islam made its appearance, the words those who follow thee, naturally came to include Muslims, who believe in the divine mission of Jesus; and history tells us that Muslims and Christians have both dominated the Jews whenever and wherever they have come in contact with them.
The prophecy about giving dominance to the believers in Jesus over his rejecters was, however, to be fulfilled in its completest form at the time of his second advent which has now taken place in the person of Ahmad, the Promised Messiah, whose message is for all the nations of the world. The clause, those who disbelieve, would, therefore, now apply to all those from among Jews, Christians, Muslims, Hindus, Buddhists and others who reject the Second Messiah who has come in fulfilment of the prophecies of both Jesus and the Holy Prophetof Islam. No wonder then that the words: "O Jesus, I will cause thee to die (a natural death)…and will place those who follow thee above those who disbelieve" also formed part of the revelation vouchsafed to Ahmad (Izalah’-i-Auham, p. 192).

Mutawaffi is derived from Tawaffa. They say Tawaffallahu Zaidan, i.e. God took away the soul of Zaid, namely He caused him to die. When God is the subject and a human being the object, Tawaffa has no other meaning than that of taking away the soul, whether in sleep or death. Ibn-e-‘Abbas has translated Mutawaffi-ka as Mumitu-ka, i.e. I will cause thee to die (Bukhari). Similarly, Zamakhshari, an Arab linguist of great repute, says: "Mutawaffi-ka means, I will protect thee from being killed by the people and will grant thee full lease of life ordained for thee, and will cause thee to die a natural death, not being killed" (Kashshaf). In fact, all Arabic lexicographers are agreed on the point that the word Tawaffa as used in the aforesaid manner, can bear no other interpretation and not a single instance from the whole Arabic literature can be cited of this word having been used in any other sense. Raf‘ signifies raising the status and rank of a person and honouring him. When the Raf‘ of a man is spoken of as being towards God, the meaning is invariably his spiritual ascension, because God not being material or confined to any place, no physical ascension to Him is possible. The word has been used in the Qur’an in this sense (24:37 & 35:11). The raising of Jesus is mentioned in the verse under comment in reply to the false claim of the Jews that he died an accursed death on the Cross.

Ja‘ala means, he made; he prepared or made; he appointed; he pronounced; he exalted (2:144); he held, etc. (Lane).

In fact, Islam attaches great importance to pacts, express or implied, and would in no case tolerate their breach. Incidentally, the verse also shows that جھاد (jihad) is permitted only against those who first make war upon the Muslims or their allies or from whom an attack is apprehended.

As when actual or virtual state of war exists there is the likelihood that a Muslim may be killed by another Muslim by mistake, the present verse gives a timely warning to Muslims to be always on their guard against such an eventuality.
In case the slain person is a believer but happens to belong to a hostile people, then the offender shall only free a believing slave and no blood-money shall be levied on him, because money paid to a hostile people would go to strengthen their military power against Islam. In the expression, and if he be of a people between whom and you is a pact, the words, and he be a believer, have not been repeated, in order to point out that the law with regard to the Dhimmis (disbelievers under the protection of Muslims), or Mu‘ahids (disbelievers belonging to a people in alliance with Muslims) is the same as for the Muslims.
It is worthy of note that disbelievers who are in alliance with Muslims have not only been placed on a par with the latter, but even a distinction has been made in their favour. In case a Muslim is slain, the command relating to the payment of penalty has been placed after the injunction to free a slave; while in case one belonging to a people in alliance with Muslims is slain, the order has been reversed; the injunction to pay the penalty to his heirs having been put before the injunction to free a slave. This has been done to impress upon Muslims the need of showing special regard for treaties and pacts. The payment of penalty was an obligation which Muslims owed to disbelievers with whom they had made a pact, and it is in order to bring home to them the lesson that they should have particular regard for their pacts and treaties, that the injunction to pay the penalty has in their case been placed before the injunction to free a slave.

Similarly, the words, and protect you against the believers, may be interpreted something like this: "We separated ourselves from the Muslims with the result that they became weak and you were thus saved from them." Or the words may mean, "some of the faint-hearted among you wished to make peace with the Muslims, but we prevented them from doing so, and now the result is that you are victorious." In the latter case the clause نمنعکم من المؤمنینwould be translated as "we prevented you from making peace with the believers".
The last sentence of the verse means that the hypocrites will never be able to bring a valid objection against Muslims.

The words, We see not with you your intercessors, imply that your hope lay in your mediators, whom you supposed to be co-partners with God and who, you imagined, would help you; but your connection with them is now completely cut off and they are not here with you to render you any help; they have failed you and become entirely lost to you.

Commentary:
The verse enunciates a great principle which should govern the social relations of Muslims. It lays down that those Muslims who live in the same country and under the same administrations, whether as immigrants or as original citizens, are bound to help one another in the hour of need. If one of them is wronged, the others must come to his help. But as regards those Muslims who have not migrated to a Muslim country and prefer to live apart, they have no claim on the assistance of these Muslims in worldly matters. But if they seek their help in the matter of religion, e.g. when they are persecuted for the sake of their religion, then they must be helped. If, however, they are living under a non-Muslim government, with whom Muslims have entered into a treaty of peace, then no help should be rendered them even in matters of religion; and in this case, the only way open to them is to migrate from the non-Muslim country. The reader should note what high regard for compacts and treaties the Quran inculcates in its followers. It is to warn Muslims against a violation of compacts that the verse fittingly ends with the words, And Allah sees what you do.

They say اوی الیه i.e. he betook himself to it; or he repaired to it for lodging, covert or refuge; or simply he betook himself to it or repaired to it; or he returned to it. اواه means, he gave or afforded him lodging, covert, refuge or asylum; or he sheltered, protected or harboured him. اوی له means, he felt compassion or pity for him. آواه means, he gave or afforded him lodging, covert, refuge or asylum; or he sheltered or harboured him (Lane).
Commentary:
The verse enunciates a great principle which should govern the social relations of Muslims. It lays down that those Muslims who live in the same country and under the same administrations, whether as immigrants or as original citizens, are bound to help one another in the hour of need. If one of them is wronged, the others must come to his help. But as regards those Muslims who have not migrated to a Muslim country and prefer to live apart, they have no claim on the assistance of these Muslims in worldly matters. But if they seek their help in the matter of religion, e.g. when they are persecuted for the sake of their religion, then they must be helped. If, however, they are living under a non-Muslim government, with whom Muslims have entered into a treaty of peace, then no help should be rendered them even in matters of religion; and in this case, the only way open to them is to migrate from the non-Muslim country. The reader should note what high regard for compacts and treaties the Quran inculcates in its followers. It is to warn Muslims against a violation of compacts that the verse fittingly ends with the words, And Allah sees what you do.

This and the preceding verse lay the greatest stress on the inviolability of oaths which should be observed at all costs.
The Arabic expression is capable of three interpretations:
(1) Because one people (non-Muslims) are stronger and wealthier than the other people (Muslims), i.e. Muslims should not put other stronger people out of their guard by concluding with them a peace treaty, thus biding their time till a favourable opportunity arises and they are strong enough to dishonour it.
(2) For fear lest one people (non-Muslims) should become stronger and wealthier than the other people (Muslims).
(3) So that one people (Muslims) should become stronger than the other people (non-Muslims), i.e. Muslims should not make a treaty with non-Muslims with this object in view that by taking advantage of it they should add to their own strength and break it when they find themselves stronger than non-Muslims.

In fact, the strict observance of covenants and fulfilment of promises are really indispensable for the maintenance of communal concord and unity; for communal concord depends on mutual cooperation and the doing of good to one another. But these things are possible only when men abide by their promises and pledges. If promises solemnly made are not kept, general distrust prevails and the result is total disintegration of the unity of the community.
The verse may not only refer to the covenants which individuals make with one another, but may also comprise that solemn compact which Muslims make at the hands of their Imam or Khalifah, binding themselves to obey him and under his guidance to strive for the progress of the community and the Faith. The Faithful are warned in this verse that since God has organized them into a united and disciplined community under one Leader to whom they have sworn allegiance, they should remain true to him and refrain from creating discord. If they failed to live up to their high ideals, Islam would lose the prestige and power it has gained through their sacrifices. The verse also teaches the great truth, which Muslim statesmen and leaders may well bear in mind, that discord created by a few individuals breaks up a whole organization and all the labour expended on the organization of the community is wasted and fresh and renewed efforts have to be made to reorganize it. They should therefore be always on their guard against mischief-makers because if they allowed their organization to be broken up, they would be like that foolish woman who, "after having made it strong, breaks her yarn into pieces".
The verse seems also to refer to compacts which Muslims in future were destined to make with other nations. In that case, it would be taken as having started a new subject and the Muslims would be regarded as having been enjoined to remain faithful to their treaties, for it is on the strict observance of treaties that the peace of the world depends. The words, you make your oaths to be a means of deceit between you, refer not only to compacts which individuals make with one another but also to the treaties which nations make with one another. To see one’s country great and powerful is a natural desire but under no circumstances is it permissible to Muslims to achieve it at the cost of treaties solemnly made or by fraudulent means. Treaties should be entered into with the noble object of maintaining international peace, and not for deceiving or harming other nations. The West may well learn a lesson from this noble teaching of the Quran.
The words, Surely, Allah tries you therewith, mean that such opportunities come as a trial, and God will see whether Muslims act upon the moral precepts of Islam or are led astray by the love of the world and imitate the example of other people. These teachings furnish remarkable evidence of the truth of the Quran and of the supremacy of Islam over other religions. The verse was revealed at Mecca, when Muslims did not possess even a single yard of land, but they were given teachings which were meant to guide the conduct of leaders of great nations and rulers of empires, and the instructions given were so noble and sublime that it was not possible to deny their superiority over other similar teachings. All the unrest and lack of trust so widespread among the nations of the world today is due to non-observance of these teachings.

But the end of all this competition and rivalry, says the verse, would be like the end of a blooming and blossoming crop over which a scorching wind has blown turning it into broken pieces of straw.

The verse implies that at the time when the great Promised Reformer to whom reference is impliedly made in the preceding verse would make his appearance, men would neglect the grim and noble purpose of their lives and would give themselves up, body and soul, to the pursuit of petty and paltry pleasures of life and there would be a mad craze and unhealthy competition among them, and vying with one another, for amassing wealth and material resources. But the end of all this competition and rivalry, says the verse, would be like the end of a blooming and blossoming crop over which a scorching wind has blown turning it into broken pieces of straw.

It constitutes an eloquent commentary on the Holy Prophet’s anxiety not to accept into the Muslim Community any woman who had fled from Mecca unless there was proof available, after subjecting her to searching examination, that she was sincere and honest in her faith and was accepting Islam from no ulterior or otherwise objectionable motives. The verse further states that the marriage-tie between a refugee believing woman and her disbelieving husband becomes automatically dissolved when she joins the Muslim Community; and a believer is allowed to marry her provided he fulfils two conditions: (a) He should have paid back to her disbelieving husband what the latter had s
