English - Hazrat Molavi Sher Ali ^ra

It does not become a believer to kill a believer unless it be by mistake. And he who kills a believer by mistake shall free a believing slave, and pay blood money to be handed over to his heirs, unless they remit it as charity. But if the person slain be of a people hostile to you, and be a believer, then the offender shall free a believing slave; and if he be of a people between whom and you is a pact, then the offender shall pay blood money to be handed over to his heirs, and free a believing slave. But whoso finds not one, then he shall fast for two consecutive months — a mercy from Allah. And Allah is All-Knowing, Wise.

اور کسی مومن کے لئے جائز نہیں کہ کسی مومن کو قتل کرے سوائے اس کے کہ غلطی سے ایسا ہو۔ اور جو کوئی غلطی سے کسی مومن کو قتل کرے تو ایک مومن غلام کا آزادکرنا ہے اور (طے شدہ) دیت اس کے اہل کو ادا کرنا ہوگی سوائے اس کے کہ وہ معاف کر دیں اور اگر وہ (مقتول) تمہاری دشمن قوم سے تعلق رکھتا ہو اور وہ مومن ہو تب (بھی) ایک مومن غلام آزاد کرنا ہے۔ اور اگر وہ ایسی قوم سے تعلق رکھنے والا ہو کہ تمہارے اور ان کے درمیان عہد و پیمان ہوں تو اس کے اہل کو (طے شدہ) دیت دینا لازم ہے اور ایک مومن غلام کا آزاد کرنا بھی۔ اور جس کو یہ توفیق نہ ہو تو دو مہینے متواتر روزے رکھنا ہوں گے۔ اللہ کی طرف سے یہ بطور توبہ (فرض کیا گیا) ہے۔ اور اللہ دائمی علم رکھنے والا(اور) بہت حکمت والا ہے۔

French

Il ne convient pas à un croyant de tuer un autre croyant à moins que ce ne soit par erreur. Et celui qui tue un croyant par inadvertance devra affranchir un esclave croyant et payer le prix du sang à ses héritiers, à moins que ceux-ci ne le remettent par charité. Mais si la victime appartient à un peuple qui vous est hostile, et qu’elle soit croyante, alors le coupable devra affranchir un esclave croyant ; et si elle est d’un peuple avec lequel vous avez fait un pacte, alors le coupable paiera le prix du sang pour que ceci soit remis à ses héritiers, et affranchira un esclave croyant. Mais celui qui n’ en trouvera aucun, jeûnera pendant deux mois consécutifs - une expiation imposée par Allāh. Et Allāh est Omniscient, Sage.

German

Keinem Gläubigen steht es zu, einen anderen Gläubigen zu töten, es sei denn aus Versehen. Und wer einen Gläubigen aus Versehen tötet: dann die Befreiung eines gläubigen Sklaven und Blutgeld an seine Erben, es sei denn, sie erlassen es aus Mildtätigkeit. War er (der Getötete) aber von einem Volk, das euch feind ist, und ist er (der Totschläger) gläubig: dann die Befreiung eines gläubigen Sklaven; war er aber von einem Volk, mit dem ihr ein Bündnis habt: dann das Blutgeld an seine Erben und die Befreiung eines gläubigen Sklaven. Italian

Non è lecito a un credente uccidere un credente, a meno che non sia per errore. E colui che per errore uccide un credente, dovrà concedere libertà ad uno schiavo credente e pagherà il prezzo del sangue ai suoi eredi, a meno che essi vi rinunzino per carità. Ma se l'ucciso appartiene a un popolo a voi ostile, ed è credente, allora il colpevole metterà in libertà uno schiavo credente; e se appartiene ad un popolo con cui avete un patto, in questo caso il colpevole pagherà il prezzo del sangue agli eredi e inoltre libererà uno schiavo credente. Ma chi non ne trovi, digiunerà per due mesi consecutivi - un modo prescritto da Allah per implorare perdono. E Allah è l'Onnisciente, il Saggio.

No es propio de un creyente matar a otro creyente, salvo que sea por error. Y quien mate a un creyente por error pondrá en libertad a un esclavo creyente, y pagará una indemnización para que sea entregada a sus herederos, a menos que éstos lo perdonen por caridad. ero si la víctima fuese de un pueblo enemigo, y es creyente, el culpable pondrá en libertad a un esclavo creyente, y si uese de un pueblo con el que tenéis un pacto, el culpable pagará una indemnización que será entregada a sus herederos y pondrá en libertad a un esclavo creyente. Mas quien no encuentre uno, ayunará durante dos meses consecutivos: como penitencia impuesta por Al-lah-. Pues Al-lah es Omnisciente, Sabio.

اور کسی مومن کی یہ شان نہیں کہ وہ کسی مومن کو قتل کرے۔ سوائے (اس کے کہ) غلطی کے (ساتھ ایسا ہو جائے) اور جو (مومن) کسی مومن کو نادانستہ قتل کردے تو (اس پر) ایک مومن (غلام کی) گردن کا آزاد کرنا‘ اور خون بہا دینا (واجب) ہوگا۔ جو اس کے ورثا کو دیا جائے گا۔ سوائے اس (صورت) کے کہ وہ اسے بطور صدقہ (چھوڑ) دیں اور اگر وہ (مقتول) کسی تمہاری دشمن قوم سے ہو اور وہ (خود) مومن ہو۔ تو (اس فعل پر صرف) ایک مومن (غلام کی) گردن کا آزاد کرنا (کافی) ہوگا۔ اور اگر وہ (مقتول) کسی ایسی قوم میں سے ہو۔ جس کے درمیان اور تمہارے درمیان معاہدہ ہو۔ تو (قاتل پر) خون بہا (واجب) ہوگا۔ جو اس (مقتول) کے ورثا کو دیا جائے گا۔ اسی طرح ایک مومن (غلام کی) گردن کا آزاد کرنا بھی ضروری ہوگا۔ اور جو (اس کی طاقت) نہ پائے۔ تو (اس پر) دو مہینوں کے متواتر روزے رکھنا (واجب) ہوگا یہ (نرمی) اللہ کی طرف سے شفقت کے طور پر ہے اور اللہ بہت جاننے والا (اور) حکمت والا ہے۔

English - Short Commentary Translation

It does not behove a believer to slay a believer unless it be by mistake.[649] And he who slays a believer by mistake shall free a believing slave, and pay blood-money to be handed over to his heirs, unless they remit it as charity. But if the person slain be of a people hostile to you, and he is a believer, then the penalty is only the freeing of a believing slave and if he[650] be of a people between whom and you is a pact, then the penalty is blood-money to be handed over to his heirs, and the freeing of a believing slave.[651] But whoso finds not one, then [a]he shall fast for two consecutive months—a mercy from Allah. And Allah is All-Knowing, Wise.

Commentary:

As the preceding verses contained injunctions which if misconstrued or misapplied, were likely to lead to a Muslim being killed by a Muslim, the present verse gives a timely warning against such an eventuality.

The words, It does not become a believer to kill a believer, have been used to make a touching appeal to believers to abstain from killing each other, since they are like brothers. It, in no case, behoves a brother to kill a brother. The words thus contain an important injunction which forms a fitting sequence to the one contained in the preceding verses concerning the hypocrites. The verse cautions a Muslim to be always on his guard lest in carelessness he should happen to kill a brother Muslim.

In case the slain person is a believer but happens to belong to a hostile people, then the offender shall only free a believing slave and no blood money shall be levied on him, because money paid to a hostile people would go to strengthen their military power against Islam which can in no case be allowed.

In the expression, and if he be of a people between whom and you is a pact, the words, and he be a believer, have not been repeated, in order to point out that the law with regard to the dhimmis (disbelievers under the protection of Muslims), or Mu‘ahids (disbelievers belonging to a people in alliance with Muslims) is the same as for Muslims.

It is worthy of note here that disbelievers who are in alliance with Muslims have not only been placed on a par with the latter, but even a distinction has been made in favour of the former. In case a Muslim is slain, the command relating to the payment of fine has been placed after the injunction to free a slave; while in case one belonging to a people in alliance with Muslims is slain, the order has been reversed, the injunction to pay the fine to his heirs being put before the injunction to free a slave. This has been done to impress upon Muslims the need of showing special regard for treaties and pacts. The payment of fine was an obligation which Muslims owed to disbelievers with whom they had made a pact, and in order to bring home to Muslims the lesson that they should have particular regard for their pacts and treaties, the injunction to pay the fine has in their case been placed before the injunction to free a slave.

کسی مومن کا یہ کام نہیں ہے کہ دوسرے مومن کو قتل کرے، الا یہ کہ اُس سے چوک ہو جائے، اور جو شخص کسی مومن کو غلطی سے قتل کر دے تو اس کا کفارہ یہ ہے کہ ایک مومن کو غلامی سے آزاد کرے اور مقتول کے وارثوں کو خونبہا دے، الا یہ کہ وہ خونبہا معاف کر دیں لیکن اگر وہ مسلمان مقتول کسی ایسی قوم سے تھا جس سے تمہاری دشمنی ہو تو اس کا کفارہ ایک مومن غلام آزاد کرنا ہے اور اگر وہ کسی ایسی غیرمسلم قوم کا فرد تھا جس سے تمہارا معاہدہ ہو تو اس کے وارثوں کو خون بہا دیا جائے گا اور ایک مومن غلام کو آزاد کرنا ہوگا پھر جو غلام نہ پائے وہ پے در پے دو مہینے کے روزے رکھے یہ اِس گناہ پر اللہ سے توبہ کرنے کا طریقہ ہے اور اللہ علیم و دانا ہے

English - Sahih

And never is it for a believer to kill a believer except by mistake. And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment presented to the deceased's family [is required] unless they give [up their right as] charity. But if the deceased was from a people at war with you and he was a believer - then [only] the freeing of a believing slave; and if he was from a people with whom you have a treaty - then a compensation payment presented to his family and the freeing of a believing slave. And whoever does not find [one or cannot afford to buy one] - then [instead], a fast for two months consecutively, [seeking] acceptance of repentance from Allah. And Allah is ever Knowing and Wise.

It belongs not to a believer to slay a believer, except it be by error. If any slays a believer by error, then let him set free a believing slave, and bloodwit is to be paid to his family unless they forgo it as a freewill offering. If he belong to a people at enmity with you and is a believer, let the slayer set free a believing slave. If he belong to a people joined with you by a compact, then bloodwit is to be paid to his family and the slayer shall set free a believing slave. But if he finds not the means, let him fast two successive months -- God's turning; God is All-knowing, All-wise.

It is not for a believer to slay another believer unless by mistake. And he who has slain a believer by mistake, his atonement is to set free from bondage a believing person and to pay blood-money to his heirs, unless they forgo it by way of charity. And if the slain belonged to a hostile people, but was a believer, then the atonement is to set free from bondage a believing person. And if the slain belonged to a (non-Muslim) people with whom you have a covenant, then the atonement is to pay the blood-money to his heirs, and to set free from bondage a believing person.
