یٰۤاَیُّہَا الَّذِیۡنَ اٰمَنُوۡۤا اِذَا تَدَایَنۡتُمۡ بِدَیۡنٍ اِلٰۤی اَجَلٍ مُّسَمًّی فَاکۡتُبُوۡہُ ۚ وَلۡیَکۡتُبۡ بَّیۡنَکُمۡ کَاتِبٌۢ بِالۡعَدۡلِ ۚ وَلَا یَاۡبَ کَاتِبٌ اَنۡ یَّکۡتُبَ کَمَا عَلَّمَہُ اللّٰہُ ۚ فَلۡیَکۡتُبۡ وَلۡیُمۡلِلِ الَّذِیۡ عَلَیۡہِ الۡحَقُّ وَلۡیَتَّقِ اللّٰہَ رَبَّہٗ وَلَا یَبۡخَسۡ مِنۡہُ شَیۡـًٔا ۚ فَاِنۡ کَانَ الَّذِیۡ عَلَیۡہِ الۡحَقُّ سَفِیۡہًا اَوۡ ضَعِیۡفًا اَوۡ لَا یَسۡتَطِیۡعُ اَنۡ یُّمِلَّ ہُوَ فَلۡیُمۡلِلۡ وَلِیُّہٗ بِالۡعَدۡلِ ۚ وَاسۡتَشۡہِدُوۡا شَہِیۡدَیۡنِ مِنۡ رِّجَالِکُمۡ ۖ فَاِنۡ لَّمۡ یَکُوۡنَا رَجُلَیۡنِ فَرَجُلٌ وَّامۡرَاَتَانِ مِمَّنۡ تَرۡضَوۡنَ مِنَ الشُّہَدَآءِ اَنۡ تَضِلَّ اِحۡدٰٮہُمَا فَتُذَکِّرَ اِحۡدٰٮہُمَا الۡاُخۡرٰی ۚ وَلَا یَاۡبَ الشُّہَدَآءُ اِذَا مَا دُعُوۡا ۚ وَلَا تَسۡـَٔمُوۡۤا اَنۡ تَکۡتُبُوۡہُ صَغِیۡرًا اَوۡ کَبِیۡرًا اِلٰۤی اَجَلِہٖ ۚ ذٰلِکُمۡ اَقۡسَطُ عِنۡدَ اللّٰہِ وَاَقۡوَمُ لِلشَّہٰدَۃِ وَاَدۡنٰۤی اَلَّا تَرۡتَابُوۡۤا ۖ اِلَّاۤ اَنۡ تَکُوۡنَ تِجٰرَۃً حَاضِرَۃً تُدِیۡرُوۡنَہَا بَیۡنَکُمۡ فَلَیۡسَ عَلَیۡکُمۡ جُنَاحٌ اَلَّا تَکۡتُبُوۡہَا ۗ وَاَشۡہِدُوۡۤا اِذَا تَبَایَعۡتُمۡ ۚ وَلَا یُضَآرَّ کَاتِبٌ وَّلَا شَہِیۡدٌ ۚ وَاِنۡ تَفۡعَلُوۡا فَاِنَّہٗ فُسُوۡقٌۢ بِکُمۡ ۗ وَاتَّقُوا اللّٰہَ ۖ وَیُعَلِّمُکُمُ اللّٰہُ ۗ وَاللّٰہُ بِکُلِّ شَیۡءٍ عَلِیۡمٌ

口授的人应该是债务人而不是债权人, 因为: (1) 负责任的是债务人; 有关决定性的话, 应该由他来选择才公正; (2) 借据由债权人而不是由债务人保存。因此要求债务人口授, 使他口授的事情可以作为借款数目和付款条件准确的证明。他就没有原因和根据来否认这笔借款。
这里含有这样的意思, 即使在这种情况下, 还是写一张像现款便笺或收条之类的字据比较好。

اِلٰی اَجَلٍ مُّسَمًّی۔ اس میں اِلٰی یا تو لام کے معنوں میں ہے اور معنے یہ ہیں کہ مقررہ میعاد کے لئے قرض لو اور اِلٰی ان معنوں میں عربی میں استعمال ہوتا ہے۔ جیسے قرآن کریم میں آتا ہے وَ الْاَمْرُ اِلَیْکِ یعنی حکم دینے کا اختیار تجھے حاصل ہے۔ یا کہتے ہیں اَحْمَدُ اِلَیْکَ اللّٰہَ: تیرے لئے اللہ کی حمد کرتا ہوں (مغنی) اور یہ بھی ہو سکتا ہے کہ اِلٰی‘ مَعَ کے معنے دیتا ہو۔ یہ معنے عربی میں مستعمل ہیں۔ قرآن کریم میں بھی آتا ہے مَنْ اَنْصَارِیْ اِلَی اللّٰہِ یعنی کون اللہ کے ساتھ ہو کر میری مدد کرتا ہے۔ اس اِلٰی کے لئے یہ شرط ہوتی ہے ک
’’تمہارے درمیان‘‘ اس کے یہ معنے بھی ہو سکتے ہیں کہ جو معاہدہ تمہارے درمیان ہوا ہے وہ لکھ دے اور یہ بھی کہ کاتب تمہارے اپنے آدمیوں میں سے ہو۔ اور یہ بھی کہ وہ دونوں فریق کی موجودگی میں ان کے سامنے بیٹھ کر لکھے۔
یہ آیت ترجمہ کے لحاظ سے بہت پیچیدہ ہے کیونکہ اس میں شُھَدَآء کا لفظ موقع پر موجود ہونے والوں کے لئے استعمال کیا گیا ہے اور ایک ہی فقرہ میں دو معنوں میں گواہ کے لفظ نے ترجمہ میں پیچیدگی پیدا کر دی ہے۔ مطلب یہ ہے کہ جس وقت تحریر لکھی جا رہی ہو اگر لکھنے والے کے سوا جو مرد و عورت وہاں موجود ہوں ان میں سے وہ دو مردوں کو گواہ مقرر نہ کرنا چاہتا ہو بلکہ کسی عورت کو بھی شامل کرنا چاہتا ہو تو اس صورت میں جو لوگ موقع پر ہوں ان میں سے دونوں فریق کے اعتباری لوگوں میں سے ایک مرد اور دو عورتوں کی شہادت ڈلوائی جائے۔
حَاضِرَۃً کا ترجمہ ’’دست بدست‘‘ کیا گیا ہے۔ یعنی جب مال پر اسی وقت قبضہ کر لیا گیا ہو اور قیمت نقد ادا کر دی گئی ہو۔
اس میں اشارہ ہے کہ اس صورت میں بھی لکھنا اچھا ہے جیسا انگریزی دکان دار ووچر (Voucher) دیتا ہے۔ اس سے جھگڑے کم ہو جاتے ہیں۔
یہ بہت بڑے سَودوں کے متعلق ہے کہ ان کو لکھنا بھی چاہیے اور گواہ بھی رکھنے چاہئیں تا فتنہ نہ پیدا ہو۔

So the borrower has been asked to dictate so that the fact of his having dictated may serve as a proof of the correctness of the amount and the conditions about payment, and he may have no cause or ground to deny it.
The implication is that it would be better to have a writing even in such a case like cash memo or voucher.

Commentary:
As the preceding verses prohibit interest and enjoin that only the original sum taken as a loan be returned to the creditor, the Quran now fittingly turns to the subject of loans not carrying interest. The verse enjoins that all transactions regarding loans should be committed to writing. It is really amazing, and is indeed a wonderful testimony to its Divine origin, that the Quran, which was revealed about 1,350 years ago when the art of writing was yet in its infancy, should lay so much stress on writing down all transactions.
The verse should not be interpreted to signify that only such transactions should be committed to writing as have a fixed term for the paying back of a loan. The injunction is general and is meant to obviate or minimize disputes so as to leave no room for doubt as to whether any amount has really been lent and as to the amount of the money lent. The words, for a fixed period, have been added to emphasize the additional fact that whenever a loan is advanced, a term must be fixed.
The verse further enjoins that when a transaction is made on credit, the document drawn up should be written by a third person so that there may be little chance of fraud and neither of the parties may have a cause of complaint against the other, both standing on the same level.

In the clause, and call two witnesses from among your men, the word "your" has been most wisely added to imply that the witnesses should not be strangers but should be known men residing in the same locality so that, if need arises, they may be easily summoned to give evidence. The words "such as you like", point to the fact that the witnesses, whether men or women, should be desirable persons and should enjoy the confidence of both parties.
The clause, and let no harm be done to the scribe or the witness, signifies that if the scribe is a professional man, he should be duly paid for his services; otherwise wrong would be done to him. Similarly, a person should not be compelled, so far as possible, to become a witness if it causes him loss of any kind. Again, the scribe or the witnesses should also be paid their travelling and other necessary expenses when they are summoned before a Qadi or judge. The words also hint that the witnesses and the scribe should not be forced or threatened or bribed or otherwise influenced to suppress the truth or tell a falsehood when called upon to give evidence.

اس جگہ حکومت کا ذکر ہے اور آیت کا مطلب یہ ہے کہ حکام کو جب چنو تو اہل دیکھ کر چنو‘ رعایت یا جَنبہ داری سے کام نہ لو۔ پھر دوسرا حصہ منتخب حکام کو مخاطب کرکے بیان کیا ہے کہ اے حکام! جب تم چنے جاؤ تو ہمیشہ عدل اور انصاف کو مدنظر رکھو اور جنبہ داری سے کام نہ لو‘ خواہ ایک فریق تمہاری پارٹی کا مخالف ہی کیوں نہ ہو۔

Authority or power to rule has been here described as a "trust" of the people in order to point out that it belongs to the people and is not the birthright of any individual or dynasty. The Qur’an disapproves of dynastic or hereditary rule and institutes instead a representative form of government. The Chief is to be elected; and in electing him the people are bidden to vote for one best fitted for the office.
The Head of the Muslim State and all those persons who are entrusted with the duty of administration are enjoined to use their authority equitably and well.
8:28.

امانات (trusts) is the plural of امانة which is derived from امن. They say امنه i.e. he trusted in him; he entrusted him with power and authority, control or a charge; he gave him a charge over a thing or person. امانة means, trustiness or faithfulness or fidelity; a thing committed to the care or trust of a person; a trust or deposit; a duty or task allotted to a person; the commandment of God given to His servants; a man’s family or household (Lane). The Holy Prophet is reported to have said that a position or office of authority is also an امانة or a trust (Muslim, ch. on Imarat).
Commentary:
As in the previous verses authority and dominion were promised to Muslims, the Quran in the present verse proceeds to bid them entrust authority to such persons as possess the necessary qualifications to rule. Authority or power to rule has been here described as a "trust" of the people in order to point out that, truly speaking, it belongs to the people and is not the birth right of any particular individual or dynasty.
The verse also draws the attention of the Muslim people to their heavy responsibility in respect of the very important matter of electing their Chief or Khalifah. They are warned that if in electing a Khalifah or a Chief they allowed considerations of personal liking or nepotism to prevail against the interests of the State or the community or those of religion and displayed lack of conscientiousness, they would be called to account like one false to his trust. The verse also condemns dynastic or hereditary rule and institutes instead a representative form of government. The Khalifah or the ruler is to be elected; and in electing him, the people are bidden to vote for one best fitted for the office. The Khalifah or the ruler in his turn is bidden to be fair and just in his administration fair to individuals, fair to communities and fair to the State as a whole.
The words, that you judge with justice, apply both to the head of the Muslim State and to all those persons who are entrusted with the work of administration. They are all enjoined to use their authority equitably and well.
The addition of the Divine attributes of "All-Hearing and All-Seeing" at the end of the verse is meant to remind Muslims that if at any time they find it difficult to carry out His commandment, then instead of violating it, they should pray to God and He will hear their prayer and will see to it that they get their rights. وَضَرَبَ اللّٰہُ مَثَلًا رَّجُلَیۡنِ اَحَدُہُمَاۤ اَبۡکَمُ لَا یَقۡدِرُ عَلٰی شَیۡءٍ وَّہُوَ کَلٌّ عَلٰی مَوۡلٰٮہُ اَیۡنَمَا یُوَجِّہہُّ لَا یَاۡتِ بِخَیۡرٍ ۖ ہَلۡ یَسۡتَوِیۡ ہُوَ وَمَنۡ یَّاۡمُرُ بِالۡعَدۡلِ ۙ وَہُوَ عَلٰی صِرٰطٍ مُّسۡتَقِیۡمٍ
This and the preceding verse refer to two different classes of disbelievers. The preceding verse refers to those disbelievers, who are slaves to superstitious beliefs and idolatrous practices and customs and, though possessing some means and the ability to do some useful work, are prevented from doing it because they are deprived of freedom of action. The present and the following section (ruku‘) establish the truth of this claim and show that the Quran eminently fulfils the supreme purpose which its revelation was intended to serve. The present verse also, as it were in a nutshell, proves this claim of the Quran to be well-founded. It contains three commandments and three prohibitions. These three commandments and prohibitions briefly embody all the various stages of the moral and spiritual development of man. The verse thus constitutes a very good example of what has been said about the Quran in the preceding verse i.e. that it is an explanation of everything تبیانا لکل شیء. The verse ends with the words لعلکم تذکرون which mean, that you may remember the obligations which you owe to God and His creatures and also that you may extol the glory of God and celebrate His praise. Since these are the objects of man’s creation, the verse gives the Faithful the glad tidings that by following injunctions embodied in it they will achieve the purpose of their creation. It is indeed marvellous that the Quran should have, in the brief compass of a short verse, thrown light on all those matters which establish its above-mentioned great claim.
It is impossible to find such combination of brevity and compre-hensiveness in any other religious Scripture. And what is more remarkable is the fact that the words of the verse are quite plain and simple and can be easily understood by a person of ordinary intelligence.
A question cannot be understood to have been fully dealt with unless light is thrown on both its positive and negative aspects. Again, a religious Scripture cannot claim to be perfect unless it possesses the following essential characteristics:
1. It must enjoin the performance of such actions as lead to man’s moral and spiritual perfection and forbid the doing of such actions as are detrimental to the realization of such perfection.
2. It must prescribe laws which are applicable not to one particular individual or community but to the largest number of individuals and communities; and in the formulation of these laws due regard should have been paid to the dispositions and temperaments of all those people for whom it is intended, so that they may not find it difficult to act upon its teaching, every person according to his or her capacity.
3. The third characteristic that a perfect Law must possess is that its teaching should be practical and practicable and acting upon it should not lead to deterioration in human morals, intellect or civilization. The present verse beautifully combines all these essential qualities of a perfect Law. It has not failed to deal properly with both the positive and negative sides of the all-important question of the moral development of man. It has enjoined justice, the doing of good to others and kindness as between kindred; and has forbidden indecency, manifest evil and wrongful transgression.
Now strict justice implies that a person should treat others as he is treated by them. He should return to others the good or evil to the extent or measure to which he has received it from them. In relation to God عدل (justice), which is the first virtue mentioned, would mean that just as God has been good to man, man should render to God His due, and should not by his conduct render Him liable to criticism. He must not give to others what is due to God, for example, his love or devotion. The association of false gods with Him is also doing injustice to God. Similarly, it is contrary to the demands of عدل (justice) that a man should arrogate to himself an attribute which belongs exclusively to God. For example, it is the special prerogative of God to reveal religious Laws. Now if any man arrogates to himself this Divineprerogative and begins to frame a religious Law and seeks to give it the status of a revealed Law, he transgresses the bounds of justice. The observance of عدل in relation to God is calculated to abolish all kinds of shirk (idolatry), infidelity and disobedience to God. Higher than عدل (justice) is the stage of احسان (goodness). At this stage man should have no regard for the kind of treatment he receives from others. He should do good to others regardless of what sort of treatment he receives from them. He must do good to others even if he is maltreated by them. His conduct at this stage should not be actuated by considerations of reciprocity but he should do good to others regardless of the fact whether he has received any good from them or even if they have ill-treated him. The promotion and patronage of knowledge and the systematization of its different branches also are included in this head because it has for its object the material and spiritual wellbeing of man.

At this stage a man is expected to do good to others not in return for any good received from them, nor with the idea of doing more good than the good received, but prompted by a natural impulse, as good is done to very near blood relations. This is a much higher moral stage than the stage of احسان (doing of good). At the stage of احسان the doer of the good may have at the back of his mind the idea that the person concerned has done him some good and that he should do him a better turn and thus win public approbation. Or, in forgiving a person who has done him some wrong, he has the satisfaction that his act of forgiveness would turn a foe into a friend. But at the stage of ایتاء ذی القربی (giving like kindred) a person does good to others prompted as if by natural impulse. His condition at this stage resembles that of a mother whose love for her children is the result of a natural impulse. Her sacrifices and the hardships she willingly suffers for her children are prompted by no hope of return or appreciation. They spring from the natural fountain of love which God has implanted in her nature. At this stage the moral development of man becomes complete.

یو۔ این۔ او بھی بزدلی دکھا رہی ہے اور ناکامی کے آثار ہیں۔ جب تک پوری طرح اس آیت میں بتائی ہوئی شرائط پر یو۔ این۔ او عمل نہ کرے گی۔ کامیاب نہ ہوگی۔
لفظ مومن سے دھوکا نہیں کھانا چاہیے۔ مومن کا لفظ اس لئے رکھا ہے کہ مسلمان قومیں مسلمانوں کے درمیان ہی فیصلہ کرا سکتی ہیں ورنہ اصولی طور پر یہ آیت ساری قوموں کے لئے اپنے اندر راہنمائی رکھتی ہیں۔
یعنی صلح کرتے وقت اپنے فوائد سامنے نہ رکھا کرو۔ اصل مسئلہ کا فیصلہ کروایا کرو۔ اس بارہ میں صرف ایک مثال ملتی ہے اور وہ امریکہ کی ہے جس نے کوریا اور سویز کے جھگڑوں میں یہ نیک نمونہ دکھایا ہے۔
اس سے مراد یہ ہے کہ ان لڑنے والی قوموں میں صلح کراتے وقت اپنا کوئی فائدہ حاصل کرنے کی کوشش نہ کیا کرو۔

A great danger to the security and solidarity of a Muslim State are the disputes and quarrels that haply might arise between different Muslim groups or parties. This verse provides an effective remedy to compose such differences. Primarily, it deals with the settlement of disputes between Muslim parties, but it equally embodies a sound basis on which a really effective League of Nations or a United Nations Organization can be built. The verse lays down a sound principle for the maintenance of international peace.

The central theme of the Surah is the solidarity of Islam. Directions and rules of conduct which are calculated to achieve and maintain this solidarity have been laid down in it in some detail. Some of these rules have been mentioned in the preceding verses, others follow in the verses that come later. As soon as there are indications of disagreement between two nations, the other nations, instead of taking sides with one or the other, should at once serve notice upon them, calling upon them to submit their differences for settlement to a "League of Nations" or "United Nations Organisation", as the case may be. If they agree, the dispute will be amicably settled. But if one of them refuses to submit to the "League", or having submitted refuses to accept the award of the "League" and prepares to make war, the other nations should all fight it. It is evident that one nation, however strong, cannot withstand the united might of all other nations and is bound to make a speedy submission. In that event, terms of peace should be settled between the two original parties to the dispute. The other nations should act merely as mediators and not as parties to the dispute, and should not put forward new claims arising out of the conflict with the refractory nation, for that would lay the foundation of fresh disputes and quarrels. The terms of peace should be just and equitable with reference to the merits of the dispute; they should be confined to the original dispute between the parties and should not be allowed to travel beyond it.
It is only such a "League" or "Organisation" which can safely be entrusted with the maintenance of international peace, not a League or Organisation whose very existence is dependent upon the goodwill of others.

لفظ مومن سے دھوکا نہیں کھانا چاہیے۔ مومن کا لفظ اس لئے رکھا ہے کہ مسلمان قومیں مسلمانوں کے درمیان ہی فیصلہ کرا سکتی ہیں ورنہ اصولی طور پر یہ آیت ساری قوموں کے لئے اپنے اندر راہنمائی رکھتی ہیں۔

یعنی صلح کرتے وقت اپنے فوائد سامنے نہ رکھا کرو۔ اصل مسئلہ کا فیصلہ کروایا کرو۔ اس بارہ میں صرف ایک مثال ملتی ہے اور وہ امریکہ کی ہے جس نے کوریا اور سویز کے جھگڑوں میں یہ نیک نمونہ دکھایا ہے۔

Commentary:
The central theme of the Surah is the solidarity of Islam. Directions and rules of conduct which are calculated to achieve and maintain this solidarity have been laid down in it in some detail. Some of these rules have been mentioned in the preceding verses, others follow in the verses that come later. A great danger to the security and solidarity of the Muslim State or Community are the disputes and quarrels that haply might arise between different Muslim groups or parties. The verse under comment provides a most effective remedy to compose these quarrels. Primarily, the verse deals with the settlement of disputes between Muslim parties, but it equally embodies a sound basis on which a really effective "League of Nations" or a "United Nations Organisation" can be built. The verse lays down the following principles for the maintenance of international peace.
